Two Workers Dead after Falling out of Boom Lift

Tragedy struck Bethany Beach on Monday, November 2nd, when two workers were killed in an industrial accident. According to the preliminary investigation, the two men were employees of an industrial telecom corporation, Velex Company. They were installing an antenna on a water tower off of Route 1 in Bethany Beach. At approximately 10:30 A.M., a strong wind gust tipped over the boom lift they were working in, which then became entangled in power lines. The two operators were pronounced dead on the scene.


Workers’ Compensation or Wrongful Death?

When these tragedies occur, it is important to note the legal options the family has. In Delaware, there is potential for Workers’ Compensation death benefits through the employer, and possibly a wrongful death/survival claim if a third party (someone other than the employer) is responsible. Furthermore, benefits are payable to the dependents of the worker as defined by the law.

Additional details surrounding this tragedy are being withheld. The Delaware Medical Examiners Office and US Occupational Safety & Health (OSHA) are assisting with the investigation.
